stowes, gap insurance is if you are upside down...i.e. you owe $19k on a car, trade it in for $15k, and buy a $20k car...you now owe $25k, which is more than the car, so if you wrecked it, you'd get $20k, have no car, and owe $5k. the gap insurance would cover that gap $5k and then you'd have nothing. that is what it is for.

i have no idea what this replacement clause is...

and can i get money over the cost of my hospital bills for pain and suffering??
Keep in mind that GAP will only cover up to 5K and no more. Been down that road already when i totaled my Jeep. I got lucky with the gap had i owed another 500.00 on the car over what my insurance covered ther would have been an out of pocket expence.

IF YOUR CAR HAS FRAME DAMAGE THEY HAVE TO TOTAL IT. CAUSE THAT MAKES YOUR CAR A SALVAGED TITLE. WHEN YOU BOUGHT THE CAR DID YOU BUY GAP INSURANCE. IF YOU DID IT WILL PAY OFF YOUR CAR UP TO 150% OF RETAIL. BUT STILL THAT SUCKS ABOUT YOUR CAR.

StoweStang- Im glad you said that because ive been sitting here for about two months thinking i was going crazy. Im like i know StowesStang had a blue stang with the same rims i know it . I thought i was losing it, I always saw your blue one on here then bam it was red. I thought you photo shopped it or something lol
ROF!!!! Man, I could have had fun with that one!!!!! LOL Seriously though, I was not ready to give up my VB baby at the time, unfortunately someone made that decision for me! lol

You would think so but ohno, trust me!! That is what pissed me off more then anything. If the damages to my car did not equal to, I believe it was 70% (my insurance would have totalled for 50%), of the car's market value, Gainsco insurance WONT total, regardless of the frame damage. And you are so right, the title would have show that and guess what, that would have been my problem to deal with. That is why I fought to the death with that insurance company and made the biggest stinkwith my "pain & suffering" claim, which by the way, the funds are paid out of separate funds then the property damage claim. So the funds are not shared, leaving room for negotiating!!

You need to call an attorney in your state, every state has different laws about these things.
