Okay, the first thing you need to do is stop worrying about the car (it CAN be replaced) and concern yourself about your injuires. See a doctor IMMEDIATELY! Then make an appointment with a personal injury attorney. I can't stress those two points enough. Once her insurance company receives the letter from your attorney, they won't attempt to play games. My wife, back in the mid 80's, was rear ended while driving her 70 Chevelle (which was in pristine condition at the time) and wound up with lower back pain and shoulder pain. We had to finally resort to a lawsuit to "rectify" the situation. The "other" insurance company finally, after almost 3 years, settled, but it took time and patience. My wife's back was never the same and as you get older, the pain from old injuries returns to haunt you. The car can be repaired/replaced. Concern youself with your injuries first. Remember, it CAN always be worse. Keep us informed of your progress. Good luck.

Glad to hear your ok man. If the frame is bent then the car is a total loss. even withthe car being a unibody therwe still may be damage to the under body of the car.

+1 to malibujerry's statements, plus I think I remember the policy I was talking about earlier, I think it is called a "keeper" or "retainer" policy

I can't remember what it is called exactly, but when I went to insure my car, they added something to my policy which basically is a replacement clause. If the car is damaged beyond a certain extent, they will not give you market value for the car, they will buy you another brand new car just like what you had. I don't know how long this is valid, I thought it was 2 years, so you might still be within the limits for this. I don't know who your insurance agency is, or if they have that, mine is Country. It's worth asking though, it costs me like another $5-$10 a month for that, something I was willing to pay for the next year or two.
I think you are talking about GAP Insurance....I have that on my stang too and it costs about an extra $300-$400 for the total note on the car.

stowes, gap insurance is if you are upside down...i.e. you owe $19k on a car, trade it in for $15k, and buy a $20k car...you now owe $25k, which is more than the car, so if you wrecked it, you'd get $20k, have no car, and owe $5k. the gap insurance would cover that gap $5k and then you'd have nothing. that is what it is for.

i have no idea what this replacement clause is...

and can i get money over the cost of my hospital bills for pain and suffering??

My injuries were minimal at best so I had a couple of dr. visits and the rest of my injury payment was pain and suffering. Remember, pain and suffering is what it is. Driving a POS rental car is suffering and that is exactly what I told the insurance company. I went after them for a DV claim and they didnt pay as much as they should or could have; that was suffering for me. I told the insurance company how I felt about the entire claim; how I was treated by their insured at the scene; how I was treated by their adjusters; again more suffering....get where Im going here? Beyond physical injuries!!!

If you read my post on my rearend crash, it breaks down the payment and how we settled.

Also remember this.................you didnt ask to be hit and have your beautiful new car destroyed and trust me, with frame damage, its pretty much destroyed because it will NEVER be the same again, dont care how good the body shop is!![]

I got in the same type of accident (hence the new bumper). First, are you positive the frame is bent? These cars are unibody , they dont have frames.
Also what did the insurance company say? all it cost for me was a new bumper and exhaust and out the door i went, everything was fine.
Only difference with my accident was it was a Mazda 3 that hit me, and they were doing around 60 with a 4-5 foot skid mark.

You certainly lucked out!!! The guy that hit me was going approx 35-40mph and never hit the brakes; pushed about 10ft (guess there). Total damagesended up over $9K with both frame rails bent. I dont know what the technical term is, maybe frame supports; when the car went up on the rack both sides were crinkled beyond the crinkle points (the areas that are designed to crinkle in a rear collison). Even the Ford body shop said it was not a job they particularly wanted to do.

So I have to say, you really got lucky at 60mph, even with skid marks! []
