Need advice: Car possibly totaled while parked?

Not even remotely a total loss for sure.
There isn't structural damage either, so if you feel that it' will be a POS from that wreck it won't be the case as long as you have a good shop handling this.

Now, your car will lose value because of this.
Make sure to get money on top of the costs of repair to make up for the loss upon re-saling/trading.
The insurance will fight you on this, trying to escape their obligations there.
Most people never get compensation on this because they don't know about it...

Unless you plan to keep that car for a long time, trade it for a new one as soon as you get it back from the shop.
The wreck won't be on Carfax yet, so let the dealer worry about it later when the trade is made.

Thanks Pascal,

CA isn't a DV state but I know I should be compensated. I agree the car isn't a total but there is about 4 hours of frame repair time to be done. If I can get a new hood like I believe I am due then I hope I can get beyond this.

What is really wrong is how GEICO wants to "do the best that they can" without actually replacing easy to remove parts like the hood. It's all about money and not what is doing right for me.

Hopefully I can get a non subjective way to determine if the hood has been repaired "perfectly". I have a phone call with the adjuster and his manager today. We'll see how that goes.

Make them replace the hood. If its the other persons insurance you can insist they put it back to the way it was- which includes a damage free, non-repaired hood. At least that is what happened with me with my '00 a few yrs ago.

I came up with 58 3/8" along the front lip of my hood using my sewing plastic measuring tape.

Of course they don't want to replace the hood...
If it's as expensive as the 05/09, they have to fork up $1300, lol.
Now, there is nothing wrong with showing them a better looking aftermarket hood you like, that would cost less than the OEM one.
That would really prove them that you're legit about not wanting that one fixed.

Yeah the hood unpainted is 1200. I had an hour long phone call with them and they are not going to replace the hood. They don't care if I place the claim through my insurance company or with them. Kona I can't thank you enough for the measurement.

Is my only recourse to take them to court? I don't understand why I have to take this when it was completely not my fault.

Anyone taken an insurance company to court over this type of stuff?

I had customers go to the small claims court and get a favorable outcome...

Not long ago, I had Fred Malibu in my shop when he had his nasty wreck.
Geico (the other party) wanted to give us a used quarter panel instead of a new one.
Not!
It seemed that they were not gonna budge until we mentioned small claim, lol.
I told them also, that I don't do "used" quarters because no Ins. Cie ever give the shop the extra labor to do it, which is half the labor on top of the allowed time.
If the book says it takes 12 hours to to replace a quarter with a new one, it take 6 hours more to extract the used skin from the bulk part that the junk yard gave you.
Those 6 hours are never paid to us. Screw that!

So yeah, mention small claim and they'll most likely listen.
Last time I checked, it cost less than $100 to file small claims in FL...
