Default E-Brake Sticking/Dealer Issue Questions

I know you guys have dealt with this kind of thing before, so I wanted some opinions before I proceed with burying my local dealership...

Over the past winter, I have had the e-brake stick numerous times and I stopped using it until it got warm again. Last week, I took my car in to the dealership for an oil change and to have them investigate the brake situation. I know that there is a TSB on the e-brake issue that tells the dealer to inspect the boot and other components in the area around the right rear brake assembly. When I picked up the car, they said they checked the TSB and did not find anything wrong. It was late and I didn't have the time to argue so I went on my way.

A few days later, I was rotating the tires and took a look at the right rear brake assembly, and... well, take a look at these pictures:





So, any thoughts?

I would take it back and demand they fix it. Or call Ford and speak with someone about this and have them deal with dealership. Tell Ford and dealership that they will be at fault if someone gets hurt.
