Man I feel your pain! Just got hit a few months back!

May I ask why you're filling under your insurance? If he hit you in the rear end it should be his insurance paying not yours? You should only need yours if his insurance is insufficient or you have a problem with them? Maybe I don't understand everything or missed something, if so sorry about that!

If you have full cover, we can claim our insurance. Our insurance will pay us first and they will ask other insurance pay them later. If you have only liability cover, you have to file claim other insurance.

you need to file a claim with the minivan's insurance company. the only thing that should go through your insurance is your car rental (just because you usually get it right away with your own insurance.)

i was in the exact same situation as you when my grand am got totaled. sitting at a light, some woman rear ended me going 45-50 mph. took out the entire back end. first thing i did when i got home was call her insurance company and file the claim. they ended up giving me replacement value for the car too.

you can do this, but keep in mind there is nothing stopping you from filing claims with both ins companies. i just think its better off keeping your insurance out of this as much as possible.

I was driving to my friends house on my way back from work and stopped at a light. This kid smashed into me going 40+. It looks like my car is going to be totaled.. the car wouldn't move. I've got a few pictures, the insurance agent said there is a good chance they wont total it, which completely blows. I've had the thing about 8 or 9 months. I'm wondering what you guys think as far as the car being repairable. If it winds up being totaled I'm probably going to have to buy a coupe, since I doubt I can afford a vert at the prices they are now. I found an 05 with low miles that is mineral gray, which happens to be my favorite color.

The pictures aren't that great. These are the ones I took with my camera phone. I wasn't really feeling too great at the time, but my friend took pictures with his phone as well. I'm not really sure how good his turned out.

Edit: It is kind of hard to see, but the rear axle is totally ****ed up. I'm not sure if the drive shaft is still mated to the rearend, it must be at least somewhat connected as the wheels moved the car forward slightly.
Don't file a claim with YOUR insurance they will raise your rates or you will be viewed as a liability. The extra work of paying you then collecting from the other insurance compay is not free to them. Your car may not be totaled but I would defintely tell the other insurance company you want the car repaired and a check ($$)for the depreciated value. If they aren't willing to do that, tell them you will be taking them to small claims court to fight for it (bluff usually works well). A depreciated value must be taken into account when a car that is less than 1-5 years old takes a hit that causes more than 20-50 or more% of the value of the car to repair and is not "totaled". Each state varies so you should check with your insurance about how to approach it.

When I was hit I called my own insurance agent and he told me that I didn't want to file on my own insurance unless it became necessary. Should the other insurance company give me problems he toldme to call back. Believe it or not it could affect your rates.[:@] Just file on the other person's insurance. In my case the other persons insurance handled everything and I was able to go where ever I wanted to get it fixed. Even allowed all my custom suspension work to be redone by the original installer no problems. Mine wasn't as bad as yours by any means but the custom suspension was expensive. Total damages were over 9 grand and they didn't even gripe.

Even covered the rental car.

Don't worry to claim our insurance. If you are not at fault, they don't rise your premium. I my case, it is better for me to claim my insurance because insurance of the other party is at other state. I think in Eastern state. Its name is strange. I have never heard of it.

Wow, glad to hear you're ok. Best of luck with USAA, I have them as well. They're usually pretty good.

Yup I have USAA as well and have never had a problem, my friend did thats because he's a dumbass and totalled his brand new stang with less than 100 miles, yes I **** you not he's a retard. He had just paid the downpayment and not the first month so he kinda screwed himself but everything worked out and I am pretty sure USAA will take care of you....

Dont let insurance f you over like that......you held up your end of the bargain by paying they're ***, so they need to own up and give you the service you payed them to give you. (although this would mean they would have to be honest/good people[>:]) If they jerk you around there is always a court to decide whos right and whos wrong....although thats a pain in your ***. Hope it turns out good for you.
