Yeah, Id say that's misrepresenting. I am NOT a lawyer though. 
I think it might be worth eating the return shipping costs to get a refund if you decide to. Sometimes you just have to cut your losses. I would figure out what is up with the frame / title before dealing with the missing parts. You have to make that call.

Your VIN may be under the pasenger side fender too. Undo the bolts along the top of the fender, and gently pull it back and look for another VIN stamp.
It could be located in up to 4 locations – Drivers side towards front, under/near notched area of fender and back near the hood hinge area on drivers side. The same goes for the passenger side.
Legally, you can’t change VIN’s from another car. That's something I wouldn't want to mess with at all. If I were to do that, I'd make sure I owned (title too) the junk it came from then cut it up and scrap it after.
VIN's have been on cars for many years befors the Mustang came out. In 1968, Ford started putting VIN tags on Mustangs on the dash and visible through the windshield. For 1965-1967, VIN's were on the inner fenders, and door data plates.

I could be wrong too. But, what I heard was that they didn't actually have a vin until '67 and then they started putting it on the dash where you see a lot of newer cars vins at. Until then, they used the warranty number as the vin. At least that's what I was told, someone let me know if it's different.

I'd say it was misrepresented by the ad. BUT he may be able to say that in HIS opinion the frame rails looked very good; I know this isn't the case, but when people use terminoligy like "good" it's up for interpretation, what is considered "very good" to one person may be considered crappy to another (as is the case here). I'm no lawyer though, far from it, but it's at least worth a try to get him to pay for the frame rails.

hhhhhhhhhmmmmmmmmm..........hey doesn't ebay offer a coverage thingy for this kind of thingy? just tel them that he misrepresented the car and that his ad was false!!!!!! they SHOULD handle the rest but i'm not sure , never been in this situation myself.

Ctrl+alt+print screen --- then go to MS Paint. Then go to edit paste.
That takes a screen capture. Might be helpful
