ugh, i really dont know what to do. i found the VIN and it worked in the decoder. so i guess we'll find out when we go to get the title and register it. i think that we might call the PO's PO and see what he has to say.
and the driver said that he would be willing to write a letter saying about the cond of the car if we decide to do anything. i guess for a witness.

Where did you find the VIN?

Have you tried contacting EBAY?

Once you title / register it, it will be harder to file a claim with EBAY.

What about the frame rails? Couldnt that cost thousands of dollars to fix?

I think the thing in the EBAY ad that you have him on is this:

"The frame rails look very good." which is a misrepresentation that should help you when you make your case to EBAY.

You need to find out if someone else has a car registered with that VIN you found. Most likely, this car is a salvage titled car, which would explain the strange Warranty Number on the Door Data Plate and why they cut the VIN out of the inner fender.

He says in the auction it comes with an Alabama Bill of Sale, which means he never registered or titled the car. This is a red flag too. If you keep the car, I sure hope NH is one of those states that accepts a Bill of Sale. Is the correct VIN, or any VIN, on the Alabama Bill of Sale?

he never gave us the bill of sale from alabama. but he said that once we give us the VIN he can get a title for us. but he never put the VIN on the bill of sale, all he said for the VIN spot was C-code.

should we contact ebay before going any further?

First thing you need to do is contact your Department of Motor Vehicles and ask if they accept a Bill Of Sale. Thats the first thing you need to do! Nothing else matters at this point.

If they DON'T then you have 2 choices.
1. Contact a Title company and see if they can get you a new Title. Note that there are a few states where this can not be done. This could cost you anywhere between 300 and 700 bucks depending on the company, the car and the state you live in *IF* they can do it for your state.
2. Contact eBay, open a dispute, contact the seller (though eBay will do that for you) and then ask for that letter from the Driver. Might also ask a mechanic or repair shop for their assessment and a letter as well. Provide these to eBay also. Might also contact a lawyer to ask for his legal advise in case eBay screws you in the end.

If they DO accept the Bill Of Sale then contact the seller. Explain to him your growing tired of his BS and if he doesn't provide you with a valid Bill Of Sale within the next day or so you'll proceed with contacting eBay and your lawyer. Personally lawyer threats are useless IMO as it doesn't scare people anymore. However if you simply contact your lawyer and THEY call the guy its real. Your choice.

Remember eBay can takes weeks and months to resolve a matter! If you decide you do not want the car because you can't title it or due to the misrepresentation of the rotten frame rails you might really want to do the lawyer route right away. Let the lawyer handle any and all conversations with the guy.

ok, weve already talked to the DMV and they do accept a bill of sale. but the bill of sale needs a VIN on it doesnt it? were going to go down to town hall or whereever and have them check the VIN that we have (the numbers that come up when you pull the fender bac, i dont think its an actual VIN?) and see what happens and hope it hasnt been registered.

if that does some how go good, should we contact ebay or a lawyer? for the frame rail repair? it seems like contacting a lawyer would be the better route? and get the driver to write up a letter and have a shop give a assesment of the damage?

The numbers you found under the fender, 6T09C26390, is the VIN for that car and the VIN needs to be on the Bill of Sale.

Has the entire drivers side inner fender apron been replaced or has just the VIN stamped area been cut off? If it's just the VIN that's been cut out, then it may be a legal cut out, to make the car a salvage vehicle. If you decide to keep the car, you may not have trouble registering it in your state as long as you have a valid Bill of Sale with the VIN on it.

I would contact EBAY and find out what your rights are for a misrepresented car auction. I would also get an estimate for repair of the frame rail and contact the seller about getting enough of your money back to make the repair on the car he said had good frame rails.

OK, so if i get him to right another bill of sale with the VIN i found on it i should be ok? and just the section has been cut out.. we will definatly talk to him and see if he will give us the money to get the frames replaced, and if not i guess we'll contact a lawyer and see what they have to say. or EBAY
